Memorandum to our Legal Friends – regarding Boundary Matters

Hi all,

I have noticed an increase in Boundary issues on recently settled contracts. Unfortunately, these are coming to me after the proud new owners have settled.

Typical issues are fences in the wrong place, sheds built over boundaries, driveways crossing the neighbours land, easements affecting the Title, etc.

Consulting Cadastral Surveyors are licensed by the State Government to deal with all Title and Boundary issues.

We can investigate, attend on site and prepare a property report at the same time as Building and Pest Inspections are being carried out in the normal contract period. Certain items, like “Material Encroachments” are grounds for termination of a contract. (As I am sure you already know).
